Alea^® S.r.l. with Sole Shareholder, headquartered in Viale Lino Zanussi, 11 – 33170, Pordenone, acting as Data Controller (hereinafter referred to as “Controller”), releases the following Agreement to the Data Subject in compliance with European and Italian data protection regulations.

The Controller has appointed a Data Protection Officer (DPO). The Data Subject can contact the DPO by writing to the following address: dpo@aleasrl.com.

This Agreement is complementary to our website navigation policy in order to inform the User on how the Company will process the data entered in this contact form. This Agreement should be read in conjunction with our privacy policy.

Purpose and legal basis of processing

Alea^® S.r.l. with Sole Shareholder, acting as Controller, processes personal data communicated through this form with the sole purpose of answering enquiries, such as providing information about products or services (including the brochure, catalog and/or additional information about the Company), quotes, etc.: no consent is therefore required as it is a requisite to answer your enquiries.

Data Retention Period

Should information be requested, the Company will hold and use the Data only as long as it is necessary to answer enquiries or send the requested material. Should a quote be requested, the Company will hold and use the Data as long as double the time before the quote expires. In case of legal dispute, further retention is reserved for the time necessary to resolve (however reached) any disputed that may arise.

Nature of data provision and consequences of refusal

The provision of data is strictly related to the use of this contact form and is therefore a necessary requirement to forward information enquiries: failure to communicate personal data may result in the inability of the Controller to provide the requested information.

The Controller will not disclose personal data, but intends to communicate it to authorized persons within its organization, based on their respective roles and responsibilities, as well as to professionals or service providers and to public and private entities, also following inspections and audits.

The data subject’s personal data may be transferred to third parties located outside the European Economic Area who provide services connected to the processing activities carried out by the Data Controller and described in this Privacy Notice or to which the transfer of data may be necessary in the context of the ongoing relationship with the data subject. Such transfer, where applicable, will be governed, depending on the recipient, by the use of standard contractual clauses adopted by the European Commission pursuant to Decision 2021/914 of 4 June 2021 and any subsequent amendments thereto or, alternatively, on the basis of an adequacy decision by the Commission and/or any other instrument permitted by law.

The Data Subject has the right to request from the Data Controller access to their personal data and to rectify it if inaccurate, to erase it or restrict its processing where the conditions are met, as well as to obtain the portability of its data. Dear Supplier,

Alea^® S.r.l. with Sole Shareholder, headquartered in Viale Lino Zanussi, 11 – 33170, Pordenone, acting as Data Controller (hereinafter referred to as “Controller”), releases the following Agreement to the Data Subject in compliance with European and Italian data protection regulations.

Purpose and legal basis of processing

The Controller processes the Supplier’s personal data for the implementation of pre-contractual measures, to comply with contractual and regulatory obligations related to the business relationship, as well as to pursue the legitimate interest in carrying out qualification and/or monitoring processes in respect of the Supplier, to manage any litigation and to generally manage the business relationship properly.

The legal basis of the processing is the pursuit of the above purposes.

Data Retention Period

The Controller will process the personal data of the Supplier for the entire duration of the business relationship and, thereafter, to fulfill any obligations connected with or arising from the establishment of the relationship for the period prescribed by law and according to the statute of limitations of the rights arising from the business relationship, without prejudice to further retention for the time necessary to the settlement (regardless of the outcome) of any disputes that may have arisen.

Provision of data and consequences of refusal

The provision of data is necessary and failure to provide personal data in whole or in part may result in the inability of the Controller to pursue the above objectives.

Categories of recipients

The Controller will not disclose personal data, but intends to communicate it to authorized persons within its organization, as well as to credit institutions or service providers and to public and private entities, also following inspections and audits.

Should the recipients process data on behalf of the Controller, they will be appointed as data processors by a contract or other legal act.

Transfer of personal data to third countries and/or international organizations

Personal data may be transferred to third parties located outside the European Economic Area that provide services related to the processing carried out by the Controller and described in this Privacy Notice, or to which the transfer of data is necessary within the scope of the ongoing relationship with the Data Subject. Such transfer, if the case arises and depending on the recipients, will be regulated either by using standard contractual clauses adopted by the European Commission pursuant to Decision 2021/914 of 4 June 2021 and any subsequent amendments,or alternatively, on the basis of an adequacy decision by the Commission and/or any other instrument permitted by the legislation. Where applicable, the transfer will be based on the conditions set forth in Article 49 of the GDPR as provided therein.

Rights of the Data Subject

The Data Subject shall have the right to contact the Controller to request access to its personal data, rectification of inaccurate data, erasure or restriction of the processing if the necessary conditions are met, as well as obtain data portability personally provided only if subject to automated processing based on consent or contract.

The Data Subject shall also have the right to revoke the consent at any time, without prejudice to the lawfulness of the processing based on the consent given before the revocation.

The legal basis of the processing is the pursuit of the above purposes.

Should a quote be requested, the Company will hold and use the Data as long as double the time before the quote expires. In case of legal dispute, the Data Retention Period may be extended until the dispute is resolved.

Should the Data Subject become a client of the Controller, data will be processed for the duration of the business relationship and, thereafter, to fulfill any obligations connected with or arising from the establishment of the relationship for the period prescribed by law and according to the statute of limitations of the rights arising from the business relationship, without prejudice to further store data for the time necessary to the settlement of any disputes that may have arisen.

Whistleblowing - INTERNAL REPORTING CHANNEL

In compliance with applicable whistleblowing legislation, Alea S.r.l. has adopted Leonardo Group’s Whistleblowing Management Guidelines which provide a common framework throughout the Group on the procedures and conditions for filing internal reports.

In this regard, Alea S.r.l. has selected the Whistleblowing Platform as its own Internal Reporting Channel, and appointed the Management Audit & Whistleblowing O.U., operating within the Group Internal Audit O.U. of the holding company, Leonardo S.p.a., as the external office in charge of carrying out any investigation activities, pursuant to Sections 4.2 and 5 of the Italian Legislative Decree n. 24/23.

In order to guarantee an effective “segregation of duties”, some phases of the whistleblowing management process are shared with the Supervisory Body of Alea S.r.l. and with the Whistleblowing Committee. Specifically, the Supervisory Body, based on the preliminary investigation prepared by the Management Audit & Whistleblowing O.U., decides, alternatively, whether to dismiss the whistleblowing report when it is either unfounded icto oculi or no additional investigation is needed, or whether to request an in-depth investigation.

Alea S.r.l., therefore, encourages anyone who becomes aware of violations (behaviors, acts or omissions) of laws or internal company protocols that are, even potentially, detrimental to the public interest or to the integrity of the Alea S.r.l., to file a whistleblowing report through the Whistleblowing Platform [it is suggested to open the link through the Google Chrome or Microsoft Edge browser].

The Whistleblowing Platform is a dedicated IT tool that uses an encryption system to ensure the confidentiality of the identity of the whistleblower, the person concerned, the person mentioned in the report, as well as the content of the report and of the relevant documentation, allowing the competent office to communicate with the whistleblower by providing an acknowledgement of receipt of the report and feedback on the action taken or intended to be taken.

Whistleblowing reports can be submitted via the Whistleblowing Platform, either in written or oral form. For the latter, the whistleblower may alternatively attach an audio file or request a face-to-face meeting with the competent office.

Anyone receiving a whistleblowing report outside the Internal Reporting Channel (Whistleblowing Platform), shall forward it as soon as possible, and in any case within 7 days of receipt, to the Management Audit & Whistleblowing O.U., in the original version, including any attachments, and in the strictest confidentiality.

In order to allow a better investigation of a whistleblowing report, the whistleblower should provide, in good faith, all useful information, including, where available, supporting documentary evidence.

Whistleblowing reports may include, but are not limited to, the following violations:

– administrative, accounting, civil and/or criminal offences;
– breaches of Leonardo Group Code of Ethics, Anti-Corruption Code, provisions of the Alea S.r.l.’s Compliance Programs, and internal procedures;
– offences falling within the scope of EU or national acts relating to the following areas: public procurement; financial services, products and markets and the prevention of money laundering and terrorist financing; product safety and compliance; transport safety; environmental protection; radiation and nuclear safety; safety of food and animal feeds and animal health and welfare; public health; consumer protection; privacy and personal data protection and security of networks and information systems;
– acts or omissions affecting the financial interests of the European Union;
– acts or omissions relating to the internal market.

Alea S.r.l. ensures protection against any act of retaliation against the whistleblower for reasons related, directly or indirectly, to his/her whistleblowing report made in good faith. In any case, in order to protect the dignity, honor and reputation of everyone, Alea S.r.l. also undertakes to offer maximum protection against defamatory reports.
